Taking steps to quash the final call given for Chief Minister Jayalalitha to appear for the IT case, she has moved on to the Madras High Court on Monday.
Jayalalitha and Sasikala are into IT cases for failure of filing tax returns in the year 1992-93 and 1993-95 which is certainly an offence as per Section 276 (CC) of I.T Act. The cases got filed during 1996. Further to a huge delay, the case appeared in the Supreme court on January 30, 2014 and it was told to get over in four months from then.
Aiming to solve the issue in an amicable way, Jayalalitha tried settling the dispute and field a compounding application to the director general of Income Tax. The issue then arrived at a position where the CM was told to appear before the court on October 1.
She has now come forward to assail the order as it has not taken under consideration the 279(2) of Income Tax Act.
