CBSE schools challenge revised fee

The Madras High Court on Monday directed the Advocate-General to serve copies of the counter affidavit on a petition challenging the orders of the Private Schools Fee Determination Committee by July 1.

In a petition, the Federation of Associations of Private Schools in Tamil Nadu, represented by its secretary, D.C.Elangovan, said the individual orders passed by the committee and the committee`s present stand in reiterating the earlier order in fixing a rigid fee without affording any opportunity of hearing did not have any legality. The orders violated the institutions` rights and violated the Constitution. The fixation of the fee without following the contemplated procedure was illegal.

Meanwhile, a charitable trust of Tiruvanmiyur filed a writ petition in the High Court challenging the committee`s order of May last year. 

The Bench listed the petitions for July 5. In the meantime, the Advocate-General should serve copies of the counter on the counsel for petitioners.
