PIL against online drugstores that sell scheduled medicines

The Madras High Court has been moved by a PIL (Public Interest Litigation) that seeks a ban on online portals that sell scheduled drugs without a doctor’s prescription. Notices were issued to state and central drug standard and control authorities by the first bench comprising of Chief Justice Sanjay Kishan Kaul and Justice M. M. Sundresh. The PIL was filed by a business from Salem. The case will be heard on April 4th next. 

Said the businessman, Medicines are not simple items of commerce, they are essential components [for] health. They must be administered in a timely manner, as prescribed by [a doctor]. As on date India had no e-medicine law for online sale of medicine.

According to the petition, Schedule H and H1 drugs were being sold by at least 3000 online drug stores. These drugs are not given without a doctor’s prescription, and doing so violates Rule 65 of Drugs and Cosmetic Rules, 1945. The PIL also demanded action against the said websites and asked for a committee to find out the total number of such websites that seen Schedule H, H1 and X drugs. 

The businessman said, These 3,000 websites offer attractive discounts which are impossible in open market sale. Some websites offer even money back guarantee in case of problems, he added.Many of these websites function from outside the country , violating laws of India. It is necessary to have a strict e-health laws and regulations in our country , and it is also necessary to have dedicated laws for websites selling drugs online.
