Chennai High Court: Online classes facility for schools-students CANNOT BE BANNED!

The Chennai High Court has rejected the appeal to impose an Interim Block on the online classes being presently conducted by the private sector schools for its students under the present lockdown situation.

The judges have ordered that the Central & State Governments should reply by providing the guidelines/regulations for streamlining the online classes being conducted.

At present, due to the lockdown imposition as a preventive measure against the spreading of the raging coronavirus pandemic, the reopening of the schools after the end of the last academic year after summer vacation has been presently banned. Hence, private schools have commenced conducting online classes for their students.

In a petition submitted to the Chennai High Court against this, it was mentioned that the students while attending the online classes, the students are getting distracted by the low-quality (sometimes obscene) advertisement on the internet.

The petitioner had appealed that until measures are undertaken that the students could not access the obscene advertisements, conducting online classes MUST NOT BE PERMITTED.

While the judges Vineeth Kothari and Suresh Kumar conducted the enquiry of this petition through video-system, The judges have raised the question to the central & state governments whether there are any regulations/guidelines for conducting online classes.

The advocate, on behalf of the State Government of Tamil Nadu, presented that the State Government of Tamil Nadu has an exclusive channel for education and that due to the prevailing lockdown situation most procedures/activities are being changed to online mode.

As such, the judges gave the verdict that at the present situation, it is NOT POSSIBLE TO PLACE AN INTERIM BAN on conducting online classes!

The judges adjourned the case until 20th June while asking the central and state governments should reply whether there are any plans to formulate the regulations/guideline for conducting online classes.
