Madras High Court dismisses writ petitions in Teacher Eligibility Test (TET) issues

On Wednesday, The Madras High Court dismissed writ petitions and an appeal for a direction to the authorities to relax the qualifying marks in Teacher Eligibility Test (TET) for reserved categories. 
 
In its judgment, the First Bench, comprising Chief Justice R.K. Agrawal and Justice M. Sathyanarayanan, said the State government had taken a policy decision not to compromise on the quality of teachers and took a conscious decision in the interest of students, not to grant relaxation to any of the categories. It was trite law that normally government’s policy decisions were not open to judicial review unless it was arbitrary and had no nexus with the object sought to be achieved. The Judges said in their considered opinion, the State Government took a conscious decision not to compromise on the quality of education and accordingly took a decision to prescribe 60 per cent as pass marks in TET examination. The guidelines/notifications issued by NCTE had not relaxed the said condition, but had given discretion to the appropriate authorities to give relaxation and thereby vested the discretion with them. The Tamil Nadu Government had also exercised the discretion in a fair and proper manner.
