Petition against the construction of MGR centenary arch

MGR Centenary Arch on the Marina Promenade is under construction and now the work may be terminated owing to the filing of PIL in Madras High Court. The petition has been filed against the construction encroaching Kamarajar Salai.

The petitioned, D. Dinesh Kumar indicated the construction of MGR arch across Kamarajar salai occupying the main arterial road in the city. The site is in front of the public works department contrary to the provisions of Tamil Nadu Highways Act, 2001. The petition was submitted to the High Court and speculations mentions the possibility of suspension of the bridge or any plan change.

The Highways act clearly implies the rule of restraining permanent buildings or structures on roads, pavements or pathways. Only temporary structures are allowed as per the law and the construction will surely lead to obstructing public with their rights for the accessibility of road built in the tax money.

The petitioner mentions that any kind of construction on the road should completely be based on the development of highways and not for other types of structures. MGR centenary building is completely unauthorized and the political structure obstructs the public rights laying permanent structures on the specific road.

The arch was planned to raise in the memory of former Chief Minister of Tamil Nadu. The ruling party of the state is in favor of the construction as it dealt with the structure oriented to their first leader. Already there are memorials for other former chief ministers against the coastal regulation rules. Now the construction of the Arch is completely favorable for one particular political party and do not serve public in any possible way. 

Earlier the statue of Sivaji Ganesan in the middle of Kamarajar Salai was removed after the court’s intervention for disrupting the free flow of traffic. Tamil Nadu government constructing the arch with an estimated budget of Rs 2.52 crore. The petitioner clearly mentioned the law of apex court regarding the ban of any construction on public roads. The plea will most probably heard on Monday said the sources.
