Supreme Court: No compensation for call drops

TRAI (Telecom Regulatory Authority of India) had ordered a regulation that in the case of calls getting drop while talking, the customer should be compensated by payment of Re. 1/- per each call drop.

However, this has been cancelled by the Supreme Court.

TRAI released the revised rules and regulations in last October. One of the regulations stipulated that customers who get call drop while talking should be compensated at the rate of Re. 1/- per call.SMS regarding the call drop and compensation should be sent to the customer within 2 hours after the call drop. As for the post-paid customers, this amount should be credited to their accounts.

The mobile operators opposed this order and filed a case in the Delhi High Court last December. However, the Delhi High Court rejected their appeal.

Following this, the mobile operators appealed to the Supreme Court in March 2016.

On hearing this appeal, the Supreme Court ruled this regulation to be against the law and cancelled it.

Mr. Kapil Sibal, the senior advocated who appeared in this case on behalf of the mobile operators, the right verdict of the Supreme Court is of historical importance.
