Posted on: 21/Feb/2014 10:38:06 AM
A Division Bench of the Madras High Court set aside the orders of the State Public Works Department to stop work, holding that construction of Chennai Port-Maduravoyal Elevated Corridor as an impending inevitability.

The Division Bench comprising Justice N Paul Vasanthakumar and Justice P Devadoss passed an order to this effect on a writ petition filed by the National Highways Authority of India (NHAI). The 53-page order directed the PWD of the Government of Tamil Nadu to co-ordinate and monitor free flow of water along with NHAI authorities and concessioner in Cooum River to work in tandem for early completion of the Rs.1800-crore project.

The Bench observed that the advantages in completing the project outweigh the alleged disadvantages and summarised the advantages that can be derived from the Mega Project.

The decision to construct an elevated expressway is a policy decision taken in public interest, after studying the feasibility report at the instance of Government of India, Ministry of Shipping, Road Transport and Highways in consultation with NHAI and as well of the State and the same was ordered to be implemented by State, the Bench noted.

It added that the policy decision was taken bearing in mind the traffic congestion in the Chennai City, free movement of cargos, vehicles to the Chennai Port Trust round the clock.
