Chennai High Court: Though Election Conduct Regulation in vogue, applications for new constructions may be reviewed

Election Code Regulations have been in vogue since the Legislative Assembly Elections are scheduled to be conducted on 16th May in Tamil Nadu.

Hence, most of the important pending decisions have been postponed to be decided after the elections.

However, the Chennai High Court has ordered the Tamil Nadu State Government not to cite this as the reason for not approving applications for the new constructions.

The federation of Indian Real Estate Developers’ Associations had filed a petition that the approval for applications for new constructions are being rejected under the grounds that Election Conduct/code regulations are in vogue.

Chief Justice S K Ghoul and Justice M M Sundaresh who heard this case,, ordered that the approval for the applications for new constructions should not be kept pending citing the Election Conduct Code and they should be taken up for review immediately.

Earlier, the advocates on behalf of the Election Commission expressed that the approval for new constructions relates to government’s policy decisions and it is a day-to-day event. The Election Conduct Code, in no way, would block this.
