High Court Verdict-Leave period of government employees can be deemed as service period for promotions

The High Court has ordered that the leave periods of the government employees, including those such as maternity leave, must be deemed as a part of the regular service period for the purposes of promotions, etc.

In a petition filed by S, Renuka, who works as a Taluk Staff in Trichy to the Madurai High Court Branch, it was mentioned that she joined as a Revenue assistant in 2001. However, my name was not included in the list of nominees for promotion to the level of Assistant Taluk Officer.

When enquiring about this with the higher officials, it was informed that the candidate had not completed the requisite services of a full period of 5 years, However, this was because that petitioner had taken maternity leave which was considered as a gap in service. Hence, the petitioner had appealed that the maternity leave period must also be deemed as a part of the regular service period and accordingly, the promotion to the higher level and the accrued financial benefits must be accorded to the petitioner.
