The case on the plot sales of agricultural lands: Ban on sales extended

The Chennai High Court has refused to repeal the ban on the registration of sales of plots originally agricultural lands.

Following the enquiry on the Public Welfare Petition submitted by Yanai Rajendran, the Chennai High Court ordered an interim ban on sales of plots which were agricultural lands on 9th September 2016.

After several stages of enquiry, the case was brought up today (Tuesday, 27th September).it was argued that by selling agricultural lands as housing plots, the area utilized for agricultural purposes has started dwindling.

However, on behalf of the Real Estate Dealers, it was argued that only approved lands being sold as plots for houses. The ban has put the public into extended hardship and hence the ban should be repealed.

The judges pointed out that that state government of Tamil Nadu had stated that a detailed report in this regard will be prepared and presented by them to the High Court. They raised the question to the advocate representing the Tamil Nadu State Government as to why the report has not been submitted so far.

The State government advocate explained that the central government has to propose the modification of the laws.  He also explained that presently, the state government has started categorizing the lands as agricultural lands, fallow lands, and unused lands.

As there is a procedural delay, the State government Advocated requested for some more time. Subsequently, the judges postponed the case to 28th March for enquiry and announced that the current ban on sales of plots for the housing of the lands used for agriculture will continue.
