60-Day Extension for NRIs to Submit Life Certificate for Property Registration

The Tamil Nadu Registration Department has issued a circular to all Sub Registrars regarding the submission of a Life Certificate for property registration through a Power of Attorney.

When a property is registered through an agent using a Power of Attorney, it is mandatory to submit a Life Certificate confirming that the person who granted the authority is alive. Until now, the certificate had to be obtained within 30 days before the date of document submission for registration.

However, people living abroad faced difficulties as they had to obtain the certificate from an Indian Embassy or a notary and send it to India by post. In many cases, the process took more than 30 days, creating difficulties in registering documents.

Following requests from the public, a relaxation has now been provided. The relaxation applies only to documents submitted for registration using a Power of Attorney executed abroad.

Under the revised provision, the Life Certificate will be accepted if it was issued within 60 days before the date on which the Power of Attorney was executed.

This relaxation does not apply to other Power of Attorney documents executed within India. District Registrars have been instructed to monitor compliance with the new guidelines during inspections.
