For not getting any deduction in the compensation money after accidents, this important rule must be followed by the two wheeler riders compulsorily!!

From every nook and corner, accidents get reported these days in Chennai and many persons suffer from grievous injuries due to the accidents. After the accidents, those persons with grievous injuries get compensation money are known. It is now revealed that the compensation issued to the persons after getting injured seriously (after the road accident) would be reduced by 15%.

Two persons who suffered grievous injuries after an accident were paid compensation after deducting 15% from the money by the city motor accident claims tribunal. The reason for that was because these persons did not wear helmets at the time of the accident. A compensation amount of Rs 10 lakh was sought by the 2 persons Mr. Ramesh Kumar and Mr. J. Anbu and they had moved to the tribunal for this purpose.

It must be noted that the accident took place on 17th July 2016 at Bharathi Salai in Chennai. A speeding SUV collided with their two- wheeler head on and they suffered severe injuries. It is true that they were treated as in-patients for more than a month.

It is noteworthy that the insurer of the SUV mentioned that the persons in the two wheelers were under alcohol and spoke about how the bikers were responsible for the accident. After pursuing the submissions, the Tribunal noted that the insurer of the SUV did not submit any proper documentary evidence to back up their claims. 

On the other hand, the accident victims provided the hospital bills and police records to prove their case.  During the cross examination both Mr. Ramesh Kumar and Mr. Anbu admitted that they did not wear helmets on that day when the accident took place.

It is learnt that the Tribunal Judge Mr. J.K. Dhilip imposed 15% contributory negligence on the victims. An amount of RS 96000 or 15% was deducted as contributory negligence for not wearing helmets.
