The All India Council for Technical Education (AICTE) has responded in its reply petition that the announcement recently made that all those students with arrears in different subjects who had paid the fees to be deemed as passed is against the Rules and Regulations.

Recently, the State Government of Tamil Nadu had released an order that the students who have kept arrears in different subjects studying in the graduate courses for Arts, Sciences, Engineering, and MCA would be deemed as passed in the arrears subjects once they had paid fees for writing the arrears examinations.

Subsequently, advocate Ramkumar Adithan and the former Vice-Chancellor of Anna University Balagurusamy had filed a petition in the Chennai High Court to cancel the above Government Order.

While conducting the enquiry of this petition, Chennai High Court had ordered the State Government of Tamil Nadu, the University Grants Commission (UGC), and the All India Council for Technical |Education (AICTE) to answer on this issue.

Now, AICTE has filed the reply petition on this case. The details mentioned in this reply petition:

Instead of conducting the examination and assessing the students, The State Government of Tamil Nadu Order declaring the students deemed as passed once they had paid the fees for writing the arrears examinations are AGAINST THE RULES AND REGULATIONS OF AICTE!

In the prevailing situation of the raging coronavirus pandemic, it is indeed difficult to conduct the examinations. So, the University Grants Commission (UGC) had sent a circular stating that the students with arrears may be permitted to advance to the next year of study and attend the online classes. HOWEVER, THE FINAL SEMESTER EXAMINATIONS MUST BE CONDUCTED.

Only those students who have written examinations and passed in all subjects must be given graduation.

No exemption has bee3n given to the students to abstain from the examinations. It had been announced that the notification that the students with arrears who had paid the ffe3es deemed as passed IS AGAINST THE RULES AND REGULATIONS.

These petitions are scheduled to be taken up for enquiry soon.
