Can you buy a vehicle without driving license?

Is it possible for one to buy a vehicle and register it in his own name when one doesnt own driving license? Well, certainly not in the state of Tamil Nadu. The difficulty here is the process of registration. Likewise, one needs to submit his PAN card details for purchase of any two wheeler that is priced more than Rs 1 lakh, as per Regional Transport Offices rules. Either of these anomalies are to be removed, the activists and consumers keep insisting the government for long.

It was back in September 2018 that the amended rules was introduced with the aforementioned anomalies. In this, the state transport department has mentioned that the dealers who sell vehicles to those who do not have driving license will be imprisoned for a period of 3 months or fined accordingly for delivering vehicles.

This rule is a burden to vehicle owners who are mere owners without driving skills! They are left handicapped with this rule. So, cant they buy a car in the city? They may even hire a driver or a call driver as per their convenience. However the rule doesnt consider your idea of driver appointment.

Not just the consumers, even the automobile dealers are perplexed with the new rule and raise questions about the amendments. They claim that the Central Motor Vehicle Act, 1988 does not have any mentioning about this rule anywhere in which the vehicle buyer must compulsorily have a driving license in his name. The president of Tamil Nadu Automobile Association claims that same. So far, whether or not a person holds a driving license, buying vehicle had nothing to do with it. This new rule may dip sales, fear dealers.

Addressing these queries and concerns, the senior transport department authorities say that the Section 180 of the aforesaid Act that the rule does not let the owner to deploy another person who doesnt have license to drive the vehicle.
